Federal Court Ruling and OCR Fines: Tips on Supporting Patient Right of Access

Description: A federal court ruled in the case of Ciox v. Azar that the HIPAA patient rate applies only to patients and not when records are provided to third parties, invalidating any contrary government guidance. This session will address the federal decision on the misuse of patient-directed record requests. Participants will gain a clear understanding of the decision, including implications for handling patient access requests versus third-party requests. We will also review civil monetary penalties the Office for Civil Rights (OCR) has issued regarding patient access and distill suggestions for how organizations can protect against potential OCR complaints.
